Section 22.01 Construction and Definition of Terms
For the purpose of this ordinance the terms and words as used herein are to be given the construction and are to be defined as I the applicable zoning ordinance in force in the Town of Hull.
Section 22.02 State Code Adopted
The Wisconsin State Building Code, the Wisconsin State Plumbing Code, the Wisconsin State Electrical Code, the Wisconsin State Heating and Ventilating Code, the Wisconsin Regulations Governing Flammable Liquids, and all acts and codes supplementary and amendatory thereto, are hereby adopted and made a part of this ordinance by reference as though included and set forth herein verbatim.
Section 22.03 Moving Buildings
1) No permit shall be granted for the moving of any building or structure to be used as a dwelling, including mobile homes, or portion thereof, which has deteriorated or been damaged to an extent greater than 50 percent of the assessed value of the building or structure. This determination shall be made by the Building Inspector.
2) No permit shall be granted for the moving of any building or structure to be used as a dwelling, including mobile homes, or portion thereof, from one location to another location on the same premises, or from one premises to another premises unless the building or structure to be moved is not so at variance with the exterior architectural appeal, general appearance, and functional plan of existing structures in the immediate neighborhood, as to cause a substantial depreciation in the property values of the neighborhood. This determination shall be made by a committee consisting of the Building Inspector and the Town Board.
3) Insurance. The applicant shall furnish a written memorandum of insurance showing that he has obtained public liability insurance coverage in the minimum amounts of $100,000, $200,000 and $50,000.
4) A “moving sign” must be used when moving homes on town roads. Forms will be provided for the signs by the Town.
Section 22.04 Authority Vested in Building Inspector
The authority to issue building permits and permits for the movement of building, and for the enforcement of this ordinance shall be vested in the Building Inspector, who is appointed and authorized to act under the zoning ordinance applicable in the Town.
Section 22.05 Inspections
The Building Inspector shall make all necessary inspections at such time as the progress in construction of the licensed projects shall warrant, and it is a condition to the continuing validity of any permit issued hereunder that any order by the Building Inspector for permitting his inspection of any part of a building be complied with.
Section 22.06 Permit Fee
The fee for a permit to move a building or structure into or within the Town of Hull shall be $5.00, and the fee for the permit is to be paid to the Town Treasurer. The treasurer will issue a receipt upon payment.
Section 22.07 Penalties
Any person, firm or corporation who shall violate any of the provisions of this ordinance, shall upon conviction thereof, be subject to a fine of not less than $10.00 nor more than $100.00 and in default of the payment of the fine and costs shall be subject to imprisonment in the county jail of Portage County until payment of the fine and costs, but not to exceed sixty (60) days for each violation thereof. Each day of violation shall constitute a separate offense.
Section 22.08 Effective Date
This ordinance shall take effect and be enforced upon passage and publication as provided by law.
