Section 59.01 Permit Required
No person, firm or corporation shall operate, maintain or have in the Town of Hull a yard or place for the storage of junk, paper or other waste materials without first securing from the Town Board a permit to operate or maintain such a yard or place of business.
Section 59.02 Fee and Duration of Permit
The fee for a permit shall be $10.00 per year and shall cover the period from July 1 st of each year to June 30 th of the following year. The permit shall be issued by action of the Town Board upon proper application and payment of the fee.
Section 59.03 Fencing and Maintenance of Sanitary Conditions Required
It shall be unlawful to maintain any yard for the storage of junk, paper or other waste materials unless the yard is enclosed with a fence not less than eight (8) feet in height and so constructed that paper or other materials cannot be blown through or under the enclosure; the yard shall be maintained in a sanitary condition so as not to create a nuisance, and shall be kept clean so that there will be no obnoxious odor.
Section 59.04 Minimum Distance From Residential Land
No yard shall be constructed or maintained within 1000 feet of any structure occupied for residential purposed.
Section 59.05 Penalty
Anyone violating the provisions of this ordinance shall be fined not less than $10.00 nor more than $100.00.
Section 59.06 Severability
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such provision and such holding shall not affect the validity of the remaining portions thereof.
